Terms and Conditions of Sale

All products made by Simone Louise Cakes (SLC) are subject to the following Terms and Conditions.
Prices

All quotations are valid for 28 days from the date of issue.
You (the Customer) agree to pay the total amount as detailed on your order form.

Bookings and Deposits

All orders and booking dates are only secured with a non-refundable deposit. Wedding cakes: 50% non-refundable deposit.
Other celebration cakes: 25% non-refundable deposit.

For wedding cakes booked 12 months or more in advance, a smaller initial deposit may be agreed. The remainder of the deposit will then be due 6 months prior to the date the cake has been booked.

Where SLC has delivered what has been quoted and invoiced, but the Customer does not accept the finished product, the deposit WILL NOT be refunded.

Final Payments

Wedding cakes: The full balance is required 4 weeks before the cake delivery date, as specified on your order form. Failure to pay the remaining balance may result in your order being cancelled and your date being made available to someone else.

Other celebration cakes: Final payment is due on or before the pickup/delivery date, and before the product leaves the premises. If paying by bank transfer, the funds must have been transferred before the cake leaves the premises.

Late or Non-Payments

Late or non-payments could result in the loss of your booking date.
In the event of a late or non-payment, your order will not proceed until alternative funding has been agreed upon and payment is made in full. In these circumstances, subsequent completion of the order on the required date will not be guaranteed and becomes subject to availability.

Cancellations

In the event of cancellation by the Customer, the deposit is non-refundable.
In addition, wedding cakes cancelled less than 4 weeks prior to the original booking date will result in the total cost of the cake being retained.

All cancellations must be made in writing. Verbal phone cancellations will not be binding.

Exceptions to this cancellation policy may be considered on a case-by-case basis due to unforeseen circumstances, such as natural disasters, emergencies, or other events beyond the control of both parties. SLC and the Customer will work collaboratively to find a fair resolution in such cases.

Unforeseen Circumstances

In the event of any unforeseen circumstances or illness that results in SLC not being able to fulfil the order, the deposit will be refunded in full within 7 days of notifying the Customer.

Change of Date

If for any reason you change the date of your event, SLC should be informed at the earliest opportunity. The new date proposed will be subject to availability.
Should SLC be unable to provide the cake for the new date, the deposit WILL NOT be refunded.

Alterations to Cake Design

Any changes to the original cake order must be communicated in writing and agreed upon by both parties. Additional charges may apply for significant alterations to the initial agreement.
No alterations will be able to be made to wedding cake designs once the balance has been paid (4 weeks prior to the wedding date).

Stand Hire

A variety of cake stands are available to hire. A refundable deposit is required for each stand, in addition to hire charges. This will vary depending on your chosen stand. Your deposit will be refunded once the stand is returned in good order, by the date agreed on your order form. Any damages and cleaning costs will be deducted from the deposit. In the event that damages are excessive, or a loss has occurred, the full deposit will be retained.

Collection

On the day of collection, your order may be collected at a pre-arranged time, as agreed on your order form.
It is the responsibility of the Customer, or any other third party collecting, to check the condition of the cake(s) before leaving the premises. Once the Product has left the premises, the Customer is responsible and assumes all liability for the safe transportation and storage of the cake.

Delivery

Delivery will be made at the agreed time and address, as stated on the order form.
If delivery cannot be made because there is no one to receive the cake, or the address provided is incorrect, the product will be returned to the premises of SLC and will be held for a maximum of 24 hours. It will be the responsibility of the Customer to arrange the collection of the cake.

Cake(s) should be inspected on receipt to ensure they are in the appropriate condition. The Customer, or any other third party taking delivery, will be solely responsible for any damage to any product after the delivery and/or as a result of failure to follow SLC’s advice on further cake transportation, or display & storage.

Consideration should be given to where you display your cake, particularly in hot weather. SLC cannot be held responsible for any damage that may occur to a cake due weather conditions. It is advisable to display your cake in a cool, air-conditioned room away from direct heat and sunlight. If your event is in a marquee, conservatory, or a room without air-conditioning, the heat and humidity may affect the quality of your cake.

Photography

SLC reserves the right to photograph the cake for promotional purposes, including but not limited to: social media, website, and marketing materials.

Other

Where colour matching is requested, an exact match cannot always be guaranteed.

SLC reserves the right to replace one or more tiers of a cake with dummy tiers if deemed necessary. The real cakes would then be supplied separately, so you would still be provided with the required number of portions agreed on in your order form.

Any cake ordered from a picture or photo of a product produced by a cake maker other than SLC will be an interpretation and NOT an exact replica.

Allergen Advice

All cakes, fillings and icings may contain, or come into contact with, soy, wheat, dairy, nuts or other allergens. It is the responsibility of the Customer to inform SLC prior to the confirmation of their booking of any allergy issues.
It is the responsibility of the Customer to inform their guests of all allergy information and accordingly, SLC will not be held liable for any allergic reaction resulting from consumption of the cake.

By confirming your booking and paying your deposit you are agreeing to the above Terms and Conditions.
